Jan. 23, 2009: “100 Best” Lawyer Speaks Out on Structured Settlements & Mediation"

    For attorney and mediator Janet Rubin Fields, the importance of physical injury and wrongful death mediations last far beyond the actual discussions. In a new article, she advises accident survivors, “The decisions you make today, especially if your injuries are severe, may be the difference between financial security and instability, as you get older.”

Voted one of the “Best Lawyers in America 2009” for alternative dispute resolution, Ms. Fields describes mediations and the role of structured settlements in an article for the current Spinal Cord Injury Life, a publication of the National Spinal Cord Injury Association.

Entitled “A Structured Solution”, Ms. Fields outlines why structured settlements and a structured settlement consultant can be an effective complement to many mediations. “All payments [from a structured settlement] are funded through a life insurance annuity, which means they are backed by multiple layers of state consumer protection regulation,” she writes.

“In addition to the guaranteed income, the federal government makes a structure financially appealing by exempting your payments from taxes on income, interest, dividends and capital gains.”
