Medicare Secondary Payer (MSP) and Medicaid compliance obligations continually evolve and affect nearly every stakeholder to a settlement. NSSTA Members must be educated on significant developments and the different perspectives from both the defense and plaintiff’s sides.
Structuring a Medicare Set-Aside (MSA) is an incredible tool for all parties involved, but without understanding the underlying complicated (and ever-changing) policy, statutes, regulations, and case law changes in Medicare and Medicaid, industry professionals will be at a disadvantage.
This Committee will provide Medicare and Medicaid compliance updates to its members and engage in dialogue that promotes learning and understanding of the relevant issues, addressing these from all perspectives.
We will cover all areas of compliance, from MSAs, liens, post-settlement professional administration and reporting requirements, to different state-level issues in Medicaid recovery and public benefits preservation considerations.
This committee seeks to serve NSSTA members who want to expand their knowledge, stay connected, and learn practical best handling practices for their businesses and clients while remaining compliant and current in the constantly changing Medicare and Medicaid landscape.

Committee Resources
The first resource the Committee would like to highlight relates to Medicaid. It comes from the Federal government and can be found here. The Committee recognizes Medicaid's complexities, compounded by state-specific rules/requirements. With this government tool, users can navigate the left-hand side of the screen to select a state and locate information regarding:
- Status of the program
- Eligibility requirements
- Enrollment information
- Program documents
- Other valuable resources.

It comes from the Kaiser Family Foundation and contains guides to each state’s Medicaid program. The Committee will continue to publish resources like this and begin aggregating them as references for the NSSTA community.
Quarterly Virtual Roundtables
The Medicare/Medicaid Compliance Committee will also begin Quarterly Virtual Roundtable sessions (ongoing), which will be open to registration for all NSSTA members. In these sessions, the Committee will cover pertinent topics of discussion around Medicare & Medicaid – in a live interactive format – by providing critical updates, information/resources, best practices, Q&A sessions, case studies, and guest speakers from across the industry who possess specialized knowledge in these areas. The Committee anticipates beginning these sessions in August 2024.
